These Terms of Service ("Terms") govern your use of the TouchUp — Botox & Filler Log application ("the App") published by Bulpara Inc ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

TouchUp is an iOS application for keeping a personal record of your own Botox and dermal-filler treatments by face zone. It lets you log treatments (brand/product, units, syringes/mL, price, provider, lot number, and zones), shows a per-zone "wear-off" countdown based on typical durations, totals your annual and monthly spend, stores before/after photos, scans receipts on-device to pre-fill entries, and exports a pre-appointment PDF and CSV. All data is stored on your device.

2. Not Medical Advice

TouchUp is a personal record-keeping tool. It is not a medical device, and it does not provide medical advice, diagnosis, or treatment. You understand and agree that:

• Wear-off countdowns are deterministic estimates calculated from typical-duration constants and your own calibration. They are not predictions of your individual results, diagnoses, or dosing guidance.
• The App does not recommend treatments, brands, dosages, injection sites, or providers.
• You should always follow the guidance of your licensed provider, and you should never make a treatment, dosing, or scheduling decision based solely on the App.
• The App is not affiliated with, endorsed by, or sponsored by any manufacturer of injectable products. Brand names are referenced descriptively so you can record what you received.

3. Acceptable Use

You agree to use the App only for lawful purposes and only to keep records you are entitled to keep. You agree not to:

• Represent the App's estimates or outputs as medical advice to yourself or others
• Add photos of other people without their knowledge or consent where required by law
• Reverse engineer, decompile, or attempt to extract the App's source or assets
• Attempt to circumvent subscription restrictions or free-tier limitations
• Use the App in any manner that violates applicable laws or third-party rights

4. Subscriptions & Billing

• Free tier: No charge. Up to 3 logged treatments, front-view face-map logging, 1 active wear-off reminder, and the last 90 days of spend insights.
• Premium Monthly: $4.99/month. Unlimited treatments, the full per-zone wear-off engine with unlimited reminders, full spend history and all charts, the before/after photo timeline, receipt quick-log, PDF and CSV export, and home-screen & Lock Screen widgets.
• Premium Annual: $29.99/year (save 50% vs. monthly), with a 7-day free trial. Same Premium feature set as monthly.
• Subscriptions are billed through the Apple App Store and are subject to Apple's Terms of Service.
• Payment is charged to your Apple ID at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel your subscription through your Apple ID settings. Cancellation takes effect at the end of the current billing period.
• If you cancel during the free trial period before the trial ends, you will not be charged.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers retain their original price for the remainder of the active term.

5. User Content

Treatments, photos, and history are stored locally on your device. You retain all rights to your data. We do not access, collect, or store your content on any server.

6. Intellectual Property

The App, including its design, code, and packaged content, is owned by Bulpara Inc and is protected by copyright and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose. Third-party brand names referenced in the App are the property of their respective owners.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT WEAR-OFF ESTIMATES OR SPEND TOTALS WILL MATCH YOUR ACTUAL RESULTS OR EXPERIENCE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BULPARA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO:

• Treatment, dosing, or scheduling decisions made with reference to the App
• The accuracy of wear-off estimates, spend totals, or any exported report
• Loss of data, photos, or history due to user error or device failure
• Subscription-related charges that fall under Apple's billing policy

9. Indemnification

You agree to indemnify and hold harmless Bulpara Inc from any claims, damages, or expenses arising from your use of the App, including any data or photos you process and distribute.

10. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the business.

11. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of the App after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws provisions.
